Mai 2000 FORIS gründet FORIS Inc. in den USA und eröffnet Büro in New York. Die FORIS AG, Marktführer der Prozessfinanzierung in Deutschland, expandiert und gründet mit der FORIS Inc. ein hundertprozentiges Tochterunternehmen in den USA. Für die Geschäftsidee der Prozessfinanzierung hatte FORIS bereits im vergangenen Jahr einen Patentantrag in den USA gestellt. Im Herbst 1999 hat FORIS das Geschäftskonzept in den USA vor Anwälten und institutionellen Anlegern vorgestellt. Die positiven Reaktionen führten zu der Entscheidung, ein Tochterunternehmen mit Sitz in New York zu gründen. Obwohl dem klägerischen Anwalt in den USA im Gegensatz zu Deutschland eine Erfolgsbeteiligung erlaubt ist, sind amerikanische Anwälte im Regelfall wirtschaftlich nicht in der Lage und daher bereit, langjährige Prozesse ausschließlich auf Erfolgsbasis zu führen. Schließlich muss auch die Anwalts- kanzlei ihren Geschäftsbetrieb unterhalten. Die Anwälte arbeiten daher häufig in Kombination eines Stundenhonorars mit einem Erfolgshonorar. Damit verbleibt ein wesentliches Kostenrisiko beim Mandanten. Viele erfolg- versprechende Prozesse werden daher auch in den USA nicht geführt. Aufgrund der Marktgröße sowie der hohen Streitwerte sind die USA der interessanteste Wachstumsmarkt für FORIS. Da FORIS selbst mit dem Anwalt als Teil der Vergütung ein Erfolgshonorar vereinbaren darf, lassen sich die amerikanischen Anwälte gern als Partner für die Zusammenarbeit mit FORIS gewinnen. FORIS had already filed a patent application last year to protect the business idea of finances legal proceedings in the U.S. In the autumn of 1999, FORIS presented the business concept in the U.S. to attorneys and institutional investors. The positive reactions led to the decision to form a subsidiary with registered office in New York City. Although plaintiffs’ attorneys are permitted contingent fees in the U.S. in contrast to Germany, U.S. attorneys are normally not in the financial position and are thus not willing to conduct years of litigation exclusively on a contingent fee basis. After all, law firms too must keep their business operations afloat. Attorneys thus frequently work for a combination of hourly and contingent fees. Clients are therefore left with substantial cost risks. Many promising cases are thus not conducted in the United States as well. Based on its market size and the high amounts in controversy, the U.S. represents the most attractive high-growth market for FORIS. Given that FORIS itself may agree upon contingent fees with attorneys as part of compensation, U.S. attorneys are pleased to be solicited as partners for cooperation with FORIS.
