to Article 21, Section 1 of the WpHG that via shares its Voting Rights on
Fresenius Medical Care AG & Co. KGaA, Bad Homburg, Deutschland, ISIN:
DE0005785802, WKN: 578580, have fallen below the 3% limit of the Voting
Rights on April 30, 2010 and on that day amounted to 2.82% (this
corresponds to 8341193 Voting Rights).
According to Article 22, Section 1, Sentence 1, No. 6 of the WpHG, 2.82% of
the Voting Rights (this corresponds to 8341193 Voting Rights) is to be
attributed to the company in connection with sentence 2 of the WpHG .
