The issuer is solely responsible for the content of this announcement. ——————————————————————————– telegate AG and BMW reach an out of court settlement BMW abandons its lawsuit and becomes 11880-customer Munich, January 22, 2002, telegate AG, the directory enquiries service provider and BMW, the car manufacturer, have now reached an out of court settlement in their lawsuit on the existing Formula 1-Sponsoring contract: telegate will pay 3.6 million Euro until January 31st, 2002. The subject matter of the lawsuit was 18.7 million Euro. As to the agreement BMW will immediately abandon its lawsuit against telegate after having received the payment. Additionally, starting from the beginning of 2002, BMW will exclusively use the telegate directory enquiry services from all their Bavarian locations for at least one year. In September last year, both companies already agreed a cooperation on the Internet-based directory enquiry service of the BMW 7. The agreed final payment puts a slight on the company, but will not impact the upward trend. Without consideration of this one-time payment, telegate AG presumes on the operative level to have finished the 4th quarter 2001 with a slightly positive EBITDA.
