Munich, October 13, 2009 - Following the oral proceedings which took place
today before the anti-trust senate (BGH KZR 41/07), the German Federal High
Court of Justice (Bundesgerichtshof) has referred the claim of telegate AG
against Deutsche Telekom AG regarding repayment of excessive data costs
(Higher Regional Court verdict dated May 16, 2007) back to the Düsseldorf
Higher Regional Court for purposes of further fact-finding, as was
expected. The Federal High Court of Justice thereby followed the legal
opinion it had expressed in its guidance order. The reasons given for the
verdict are not yet available.
As before, telegate AG continues to expect to be able to enforce its
recovery claims against Deutsche Telekom AG.
