Munich / Planegg, 28 May 2013 - Cologne Regional Court, the court of first
instance, today dismissed a lawsuit brought by telegate AG against Deutsche
Telekom AG (file no. 87 O 7/06). The suit asked for damages amounting to at
least EUR 86 million for actions contravening competition law. This
decision was a surprise to telegate AG: In proceedings concluded in 2012, a
final ruling by Germany's Federal Court of Justice already found that
Deutsche Telekom AG had acted in violation of competition law to improperly
inflate data costs.
The current case involves compensation for losses suffered by telegate AG
during the deregulation phase of the telephone directory assistance market
due to illegal inflation of data costs by Deutsche Telekom AG. The reasons
for today's ruling are not yet available.
After receiving a copy of the decision, telegate AG will immediately
investigate the chances of success of an appeal. The company currently
believes these to be good.
