The United States Court of Appeals for the Federal Circuit announced its
decision vacating the district court's orders granting summary judgment of
non-infringement and invalidity of the LMA patent. The Court remanded the case
to the district court in San Diego, where trial will be held on Ambu's
non-infringement and invalidity defenses, including Ambu's claims against LMA
for false advertising and unfair competition.
