CopyTele, Inc. (the "Registrant") is filing this Form 12b-25 to report that it
is unable to file its Quarterly Report on Form 10-Q for the three months ended
July 31, 2008 within the prescribed time period without unreasonable effort or
expense, because certain aspects of the Registrant's review process with respect
to its financial statements have not been completed prior to the required filing
date. Registrant's Quarterly Report on Form 10-Q is being filed
contemporaneously with the filing of this Form 12b-25.

         Exchange Commission, Washington, D.C. 20549, in accordance with Rule
         0-3 of the General Rules and Regulations under the Act. The information
         contained in or filed with the form will be made a matter of public

         securities of the registrant is registered.

Registrant's results of operations for the three and nine months ended July 31,
2008 are expected to be affected by increases in research and development
expenses and selling, general and administrative expenses as compared to the
comparable prior-year periods, as well as an increase in net revenue as compared
to the comparable prior-year periods principally due to revenue from display
technology license fees related to Registrant's Technology License Agreement
with Videocon Industries Limited.
