SUBSEQUENT EVENTS On March 26, 2019, the U.S. Court of Appeals for the Fifth Circuit issued an opinion affirming the take nothing judgment of the District Court in the Company and an officer’s suit against BD.  The Company is evaluating this ruling and conferring with legal counsel regarding possible future action.
