January 2008 – Artec technologies (XETRA: A6T) of Diepholz, Germany, has obtained a preliminary injunction from the district court in Duesseldorf against Arcor, Eschborn. The reason for this legal action: The Diepholz company sees in Arcor’s IPTV service offering 'Timeshift Restart' a violation of artec’s time-shifted television patent. At the Duesseldorfer district court, the attorneys for artec technologies, a company registered in the Entry Standard of the Frankfurt Stock Exchange, submitted an extensive petition for an investigation and detailed their reasons for suspecting a patent violation. The court granted the petition and, at the end of December, reached the decision that Arcor must accept a search of equipment and documents at its premises by a court-appointed investigator. Artec, operating out of Lower Saxony in Germany, saw itself forced to take such legal steps after repeatedly but unsuccessfully calling upon Arcor to state its position on artec’s concerns. The reason for proceeding in this manner is to be found in the great strategic significance which artec ascribes to its process for time-shifted television. In 2001, Artec submitted this process to the patent office and received the patent protecting the process in June, 2006. With the process developed and patented by artec technologies, TV programs are stored on central servers and all of these functions are implemented through those servers. Even during a broadcast, contents can be called up individually by a number of users at the same time. The users do not need additional hardware or software, but instead can easily and simply take advantage of these functions via their TVs, PCs or even mobile phones.
