Correction ad hoc release 9. October 2001
Yesterday’s ad hoc release incorrectly named Busi-ness Software Association as
the plaintiff in the respective claim against optimal media production GmbH.
Correct is that the companies Adobe Systems Inc., Auto-desk Inc., Corel
Corporation, Microsoft Corporation and Symantec Corporation are the plaintiffs
in this claim. For clarification reasons we also point out that the orders in
question were third party orders.
Please find below the corrected version:
The companies Adobe Systems Inc., Autodesk Inc., Corel Corporation, Microsoft
Corporation and Symantec Corporation have jointly filed a partial claim against
opti-mal media production GmbH, a subsidiary of edel music AG, regarding alleged
copy-right infringements. They claim damages of DEM 22 million, which they say
have oc-curred in connection with third parties’ pressing orders fulfilled by
optimal media pro-duction. The pressing orders in question had a total value of
approximately DEM 66,000 (net). After careful evaluation by edel music AG’s
lawyers in respect of the proceeding’s outcome, the company expects a dismissal
of the suit. However, an estimated accrual will be set up as a precautionary
measure.
