HMS Bergbau AG: Consistent implementation of strategy to focus operations
purely on trading

- Sale of Polish subsidiary HMS Niwka Coal Production Sp. z o.o.
- Revenues from sale to cover project costs
- Focus turned to Asian coal market

Berlin, 20 December 2012: HMS Bergbau AG, a global coal trading company
with operating expertise in the production, transportation and trade of
coal products, has sold all of its shares in HMS Niwka Coal Production Sp.
z o.o. to Ichor Coal N.V.. Ichor Coal N.V. will take over responsibility
for the continued development of the coal mining project and the licensing
process for the re-opening of the mine Niwka Modrzejow. From now on Ichor
Coal will bear all costs associated with the project and make available the
personnel resources to further advance the project. If the HMS Niwka coal
project is successfully implemented, Ichor Coal intends to appoint HMS
Bergbau AG as a sales partner for all coal products stemming from the
project.

By selling the Polish subsidiary to its parent company Ichor Coal N.V., HMS
Bergbau AG is consistently implementing its strategy to focus its
operations on trade and sales predominantly in the Asian and the African
coal market.

'The revenues from the sale of HMS Niwka cover all costs that have arisen
from the development of the Polish company,' said Sebastian Giese, CFO of
HMS Bergbau AG. 'In addition, the funds that had originally been ringfenced
for the project are now also available for the continued strategic
development of HMS Bergbau AG.'
