Notificationof unauthorized withdrawal of access to the ESPI system by theCompulsory Administrator Marcin Kubiczek

TheManagement Board of AFORTI Holding S.A. in restructuring with itsregistered office in Warsaw (hereinafter referred to as the "Company")hereby informs that the Warsaw Stock Exchange S.A. has ordered theCompany to be transparent and to provide all information to the public.The Company informs that it has been deprived of the possibility ofpublishing ESPI announcements for nearly 3 months.

TheCompany informs that the Compulsory Administrator Marcin Kubiczek -without consulting the Company - at the beginning of December 2024submitted to the Office of the Polish Financial Supervision Authority(hereinafter referred to as the KNF) an application to withdraw theCompany's access to the ESPI system, which was done by the KNF withoutconsulting the Company. In January 2025, the Company submitted to theKNF a request to clarify the situation and return the access. Afteranalyzing the case, the KNF agreed with the Company, recognized theactions of the Compulsory Administrator Marcin Kubiczek as unauthorizedand granted access to the Company's representatives on February 28,2025. The KNF clearly indicated that the scope of the powers of theCompulsory Administrator Marcin Kubiczek does not include applying towithdraw or grant access to System Operators acting on behalf of theCompany, as these activities are not part of the management of assetsfor security purposes.

TheCompany informs that the Compulsory Administrator, Marcin Kubiczek, hasrepeatedly taken actions inconsistent with the Court's decision ofOctober 14, 2024 regarding the change of the method of security, inwhich decision the Court clearly stated: THE ROLE OF THE SECURITY IS NOTTHE TAKEOVER OF THE DEBTOR'S ENTERPRISE BY THE COMMUNIONAL ADMINISTRATORAND ITS FURTHER OPERATION.
