Subject: The judgment of the court on statement of claim for repealingthe resolution of the Ordinary General Meeting of Energa SA

With reference to current report No. 39/2022 of 8 August 2022 theManagement Board of Energa SA ("Company") informs that on 23 January2024 it received information that the Regional Court in Gdańsk, 9thCommercial Division issued a judgement dismissing the statement of claimfor repealing the resolution No. 5 of the Ordinary General Meeting ofthe Company on 20 May 2022 on the distribution of the net profit for thefinancial year 2021 and allocation of this profit in full to the reservecapital and awarding the court costs from the Company in favour ofplaintiffs.

The court refrained from providing oral reasons for the decision. Thejudgment is not final.
