The Management Board of Vivid Games S.A. (hereinafter _quot;Issuer_quot;,_quot;Company_quot;) in reference to the ESPI current report No. 28/2023 of August21, 2023, informs that on December 21, 2023, it decided to file alawsuit against the National Center for Research and Development(hereinafter _quot;NCBiR_quot;). The lawsuit will be filed with the District Courtin Bydgoszcz, 1st Civil Division by the end of December 21, 2023.

In the lawsuit, the Company requests that the NCBiR declare ineffectivethe termination of the grant agreement for the implementation of thetechnology project entitled _quot;Prototype platform for automation ofgeneration, gamification and difficulty determination of blast levels,based on AI and Machine Learning_quot; (hereinafter: the _quot;Project_quot;), underthe Fast Track program, on August 21, 2023. At the same time, theCompany seeks an award of a portion of damages for costs incurred inconnection with NCBiR's breach of contract.
