In the decision of the Competition Authority, which was notified to us on 28.10.2021, within the scope of the investigation regarding the pricing behavior of the chain markets engaged in the retail trade of food and cleaning products and their supplier producers and wholesalers during the COVID-19 epidemic;


· It has been stated that five chain markets including our company and a supplier company violated Article 4 of Law No. 4054 with the allegation that they formed a "cartel",

· Therefore, in accordance with the third paragraph of Article 16 of the Law and the " Regulation on Fines to be Imposed for Anticompetitive Agreements, Concerted Practices, Decisions and Abuse of Dominant Position ", an administrative fine of 958,129,194.39-TL, which is 1.8% of the annual gross revenues, at the end of fiscal year 2020 has been appraised to BİM Birleşik Mağazalar A.Ş.,

· Within 60 days from the date of notification of the reasoned decision, which will be notified to our company separately, the judicial remedy is open in Ankara Administrative Courts.

If the said administrative fine is applied with a 25% discount in accordance with the 6th paragraph of the 17th article of the Law No. 5326, the penalty amount will be 718,596,896-TL.

None of the accusations imputed in the relevant decision are accepted by us, and this matter has been presented to the Board with the evidence in both our written and verbal defenses since the beginning of the investigation. For this reason, BİM will defend its rights to the end and will comprehensively take the decision to the judiciary.
