oda_ExplanationTextBlock|		Rekabet Kurulu tarafından Şirketimize iletilen yazıda; Rekabet Kurulu'nun 2009 yılında otomotiv sektörüne yönelik olarak getirilen ÖTV indirimi kapsamında, yeni binek otomobil ve hafif ticari araç üreticisi ve dağıtıcısı teşebbüslerin ÖTV indirimi sonrası birlikte hareket ederek fiyat artışı yaptıkları ve mal arzını kısıtladıkları yönündeki şikayetlerin reddine ve soruşturma açılmasına gerek olmadığına ilişkin 24.06.2009 tarihli kararının Danıştay tarafından 04.12.2019 tarihinde iptal edilmesini takiben, söz konusu iptal kararının gereğinin yerine getirilmesini teminen 4054 sayılı Rekabetin Korunması Hakkında Kanun'un 4. maddesinin ihlal edilip edilmediğinin tespitine yönelik olarak Şirketimiz nezdinde soruşturma açılmasına karar verildiği belirtilmekte ve bu kapsamda Şirketimizden savunma talep edilmektedir. Bilindiği üzere Rekabet Kurumu tarafından soruşturma açılması, soruşturmaya konu teşebbüslerin ya da teşebbüs birliklerinin 4054 sayılı Kanun'u ihlal ettikleri, Kanun kapsamında ceza yaptırımı ile karşı karşıya kaldıkları veya kalacakları şeklinde yorumlanamaz. Konu hakkındaki gelişmeler Sermaye Piyasası Mevzuatı çerçevesinde gerektiğinde kamuoyu ile paylaşılacaktır. İşbu açıklamamızın İngilizce çeviri metinlerinde herhangi bir farklılık olması durumunda, Türkçe açıklama esas kabul edilecektir.		In accordance with the letter sent by the Competition Board, an investigation was initiated against our Company in order to determine whether there has been a violation of Article 4 of the Law No. 4054 on the Protection of Competition and plea of our Company has been requested in this context. The investigation has been initiated on the ground of execution of State Council's judgement dated on 04.12.2019, which cancelled the decision of the Competition Board dated on 24.06.2009. The Competition Board decided not to open an investigation and refusal of the complaints which were accusing that the new passenger car and light commercial vehicle manufacturer and distributor undertakings had increased prices and restricted the supply of goods by acting together following the special consumption tax discount introduced for the automotive industry in 2009. As it is known, opening an investigation by the Competition Authority cannot be interpreted as the undertakings or association of undertakings subject to the investigation violate the Law No. 4054, as being or will subject to penalty under the Law. Developments on this disclosure will be shared with the public when necessary within the framework of the Capital Market Legislation.
