İlgide kayıtlı açıklamalarımız ile; Rekabet Kurulu'nun Bankamıza idari para cezası verilmesine dair 08.03.2013 tarihli ve 13-13/198-100 sayılı kararına karşı açılan iptal davasında verilen red kararının Bankamız lehine bozularak Ankara 2. İdare Mahkemesi'ne gönderilmesine karar verildiği duyurulmuştu.

İlerleyen süreçte, Ankara 2. İdare Mahkemesi tarafından öncelikle ısrar-ret kararı verilmiş, söz konusu kararın Danıştay İdari Dava Daireleri Kurulu'nun 31.05.2021 tarih ve 2019/2709 E., 2021/1109 K. sayılı kararı ile bozulması üzerine bu defa Ankara 2. İdare Mahkemesi'nin 28.04.2022 tarihli 2022/921 E., 2022/877 K. sayılı kararı ile Rekabet Kurulu'nun idari para cezasının iptaline karar verilmiştir.

Söz konusu iptal kararı, Danıştay temyiz ve karar düzeltme süreçlerinden de geçerek Danıştay 13. Daire'nin 2023/1809 E. ve 2023/3748 K. sayılı kararıyla Bankamız lehine kesinleşmiştir.

It was announced with the referred disclosures that the rejection decision given in the annulment case filed against the Competition Board's decision dated 08.03.2013 and numbered 13-13/198-100 regarding the imposition of an administrative fine on VakıfBank was reversed in favour of VakıfBank and it was decided to send it to Ankara 2nd Administrative Court.

In the following process, initially, the Ankara 2nd Administrative Court issued a decision of insistence-rejection, and upon the reversal of the relevant decision by the decision of the Council of State Board of Administrative Appeals dated 31.05.2021 and numbered 2019/2709 E., 2021/1109 K., this time with the decision of Ankara 2nd Administrative Court dated 28.04.2022 and numbered 2022/921 E., 2022/877 K., it was decided to cancel the administrative fine of the Competition Board.

The aforementioned cancellation decision passed through the appeal and revision processes and was finalised in favour of VakıfBank with the decision of the 13th Chamber of the Council of State with the decision numbered 2023/1809 E. and 2023/3748 K.

According to CMB legislation, in case of a contradiction between the Turkish and English versions of this public disclosure, the Turkish version shall prevail.
