The plaintiff is Meridian Solare Energieprojekte GmbH in Hildburghausen. From assigned right, they assert a claim of payment against RPSE AG of 100,000 EUR. In this case and according to the statement of claim, it concerns a partial sum of an alleged claim for indemnification totaling approx. 8.45 million EUR. The background of the suit is a printed statement from Talis Projektmanagement und Verwaltungs GmbH in Hildburghausen in the security folder of Reinecke + Pohl Sun Energy AG dated February 10 2006 (P. 13 and 72). It states, that RPSE AG had culpably neglected to execute the contribution of Meridian Solare Energieprojekte GmbH, which was agreed upon under dilatory conditions in the fiscal year of 2005 (cp. the ad hoc notice of BK Grundbesitz und Beteiligungs AG dated February 09 2005). The claim for indemnity will be affiliated from a RPSE AG lost stock price gain. RPSE AG is of the opinion, that the complaint is unjustified.
