Pursuant to a decision by the Slovakian national highway authority NDS, the
consortium lead by Kapsch TraffiCom AG has been excluded from the tender for the
implementation and subsequent operation of a nationwide electronic truck tolling
system in Slovakia. The NDS stated that its decision was based on certain
deficiencies of the submitted offer. This statement is in Kapsch TrafficCom´s
view unfounded and without merits as the offer submitted by Kapsch TrafficCom is
in compliance with the tender documents. Therefore, Kapsch TrafficCom is
currently evaluating an objection against the decision of NDS, which objection
would have to be filed by May 9, 2008.
