30.04.2024 Tarihli Özel Durum Açıklamamız ile; "Ankara 14. İdare Mahkemesinin 2024/294 Esas ve 2024/386 sayılı kararı ile, Rekabet Kurulu'nun 08.07.2013 tarihli ve 13-42/538-238 sayılı kararının iptal edilmesine karar verildiği, bu kapsamda Rekabet Kurulu tarafından yapılan duyuru ile; İlgili mahkeme kararının gereğinin yerine getirilmesini teminen şirketimizin de aralarında bulunduğu kuruluşlar hakkında 24-14/284-M saylı karar ile yeniden soruşturma açılmasına karar verildiği" kamuoyuna duyurulmuştur.

Rekabet Kurumu Başkanlığı tarafından şirketimize gönderilen 11.04.2025 tarihli yazı ile;

1-Kartonsan Karton San. ve Tic. AŞ hakkında idari para cezası uygulanmasına gerek olmadığına,

2-Kartonsan Karton San. ve Tic. AŞ ile Olmuksan International Paper Ambalaj Sanayi ve Ticaret AŞ'nin Dönkasan Dönüşen Kağıt Hammaddeleri San. ve Tic. AŞ aracılığıyla kurduğu yatay işbirliği anlaşmasının şikâyete konu dönemde 4054 sayılı Kanun'un 4. maddesi kapsamında olduğuna, bununla birlikte söz konusu anlaşmanın ilgili dönemde 4054 sayılı Rekabetin Korunması Hakkında Kanun'un 5. maddesi çerçevesinde bireysel muafiyet şartlarını sağladığına,

3- Gerekçeli kararın tebliğinden itibaren 60 gün içinde Ankara İdare Mahkemelerinde yargı yolu açık olmak üzere 25-14/323-153 sayı ile karar verildiği,

Hususları bildirilmiştir.

İş bu açıklamamızın İngilizce çevirisi ekte yer almakta olup, açıklama metinlerinde herhangi bir farklılık olması durumunda Türkçe açıklama esas kabul edilecektir.

With our Material Event Disclosure dated 30.04.2024; "With the decision numbered 2024/294 Esas and 2024/386 of Ankara 14th Administrative Court, it was decided to cancel the decision of the Competition Board dated 08.07.2013 and numbered 13-42/538-238, and in this context, with the announcement made by the Competition Board; In order to fulfill the requirements of the relevant court decision, it was announced to the public that it was decided to reopen an investigation with the decision numbered 24-14/284-M against the organizations including our company".

With the letter dated 11.04.2025 sent to our company by the Presidency of the Competition Authority;

1-Kartonsan Karton San. ve Tic. A.Ş that there is no need to impose an administrative fine,

2-Kartonsan Karton San. ve Tic. AŞ and Olmuksan International Paper Ambalaj Sanayi ve Ticaret AŞ through Dönkasan Dönüşen Kağıt Hammaddeleri San. ve Tic. AŞ was within the scope of Article 4 of the Law No. 4054 during the period subject to the complaint, and that the said agreement met the conditions for individual exemption within the framework of Article 5 of the Law No. 4054 on the Protection of Competition during the relevant period,

3- It was decided with the number 25-14/323-153 to be open to judicial remedy in Ankara Administrative Courts within 60 days from the notification of the reasoned decision,
