oda_ExplanationTextBlock|		16.07.2024 tarihli özel durum açıklamamız ile Divan Talya Otelimizin yeniden yapımı ve Konferans Merkezi'nin yenilenmesi projesi ile ilgili olarak 1/5000 Ölçekli Nazım İmar Planı ve 1/1000 Ölçekli Uygulama İmar Planı ile otel inşaatı için verilen inşaat ruhsatının iptali talebi ile Antalya Büyükşehir Belediye Başkanlığı ve Muratpaşa Belediye Başkanlığı aleyhinde açılan davada; Antalya İdare Mahkemesi tarafından 1/5000 ölçekli Nazım İmar Planının iptali talebinin reddine; 1/1000 ölçekli Uygulama İmar Planı ile bu plana bağlı inşaat ruhsatının iptal talebinin ise kabulüne oyçokluğu ile karar verildiği kamuya açıklanmıştı. Karara istinaden Muratpaşa Belediye Başkanlığı tarafından 26.07.2024 tarihi itibariyle inşaattaki inşai faaliyetlerin durdurulmasına karar verilmiştir. 16.07.2024 tarihli özel durum açıklamamızda belirtildiği üzere, ilk derece mahkemesi tarafından verilen söz konusu karar kesin nitelikte olmayıp karara karşı istinaf yolu açıktır. Antalya Büyükşehir Belediye Başkanlığı tarafından karara karşı istinaf yoluna başvurulduğu öğrenilmiş olup Şirketimiz tarafından da istinaf yolu ile karara itiraz edilecek ve ayrıca inşaat ruhsatının iptali ile inşaatın durdurulmasına ilişkin işlemin yürütmesinin durdurulması talep edilecektir. Konuya ilişkin gelişmeler konunun önemine göre özel durum açıklaması ve/veya faaliyet raporlarımız aracılığıyla yatırımcılarımız ile paylaşılacaktır.		With the special situation statement dated 16.07.2024, it was announced that in the case filed against the Antalya Metropolitan Municipality and Muratpaşa Municipality requesting the cancellation of the 1/5000 Scale Master Zoning Plan, 1/1000 Scale Implemantation Plan and the construction license attached to this plan given for the reconstruction project of Divan Talya Hotel and the renewal of the conference center ; Antalya Administrative Court rejected the request for cancellation of the 1/5000 scale Master Zoning Plan and accepted the request for cancellation of the 1/1000 scale Implementation Plan and the construction license attached to this plan by majority vote. Based on the court decision, Muratpaşa Municipality decided to stop the construction as of 26.07.2024. As stated in the special situation statement dated 16.07.2024, the decision given by the first instance court is not final and an appeal against the decision is open to a higher court. It has been learned that Antalya Metropolitan Municipality has filed an appeal against the court decision. Our company will also file an appeal against the court decision along with a request to stay of execution of cancellation of the 1/1000 Scale Implementation Plan and the construction license attached to this plan. Developments regarding the issue will be shared with our investors through special event disclosure and/or activity reports, depending on the importance of the issue.
