(4) EMPLOYEE BENEFIT
PLANS
401(k)
Profit Sharing Plan
The
Company has a 401(k) profit sharing plan, which permits
U.S. employees of the Company to contribute up to 50% of
their annual compensation, up to certain Internal Revenue
Service limits, on a pretax basis. The contributions made
by each employee are fully vested immediately and are not
subject to forfeiture. The Company makes a discretionary
matching contribution of up to 50% of the employee's
contribution up to 5% of their annual compensation.
Effective April 1, 2009, the Company suspended the
discretionary matching contribution. The Company reinstated
the discretionary matching on October 1, 2010. Employees
vest in the Company's contribution to the plan at the rate
of 20% per year from the date of employee anniversary.
Contributions made by the Company during 2012, 2011, and
2010 amounted to $128,000, $109,000, and $0,
respectively.
